How to check if your license is suspended

The most common question here is not a question at all but a task, and it has a free answer: your state publishes the check. Sites that charge to look this up are selling what the agency gives away, and their data is second-hand.

Other states run the same kind of service under their own licensing agency — look for the department named on your court paperwork rather than for a search result. Note that a status screen is usually not a certified record: if you need proof for an employer or a court, order the record itself.

Restricted, hardship, occupational — often the same thing

States name it differently and hedge it differently, but the idea is constant: permission to drive for specific purposes during a suspension, usually work, treatment and school. California issues a restricted license in place of an insurance suspension and keeps the insurance filing running through it. Oregon calls it a hardship permit and blocks it for at least 90 days after a refusal — up to three years depending on record. Arizona has a special interlock restricted license of its own.

Two practical points get missed. First, the exception is narrow: driving outside the permitted purposes is itself an offense, and a serious one. Second, the paperwork underneath keeps running — the insurance filing and, in most states, the interlock stay in force through the restricted period rather than pausing.

The hearing is requested, not scheduled for you

The licensing case runs on its own clock and nobody starts it on your behalf. In North Carolina the revocation takes effect on the thirtieth day after the order is mailed unless you request a hearing in writing before then. Oregon gives a written notice of intent to suspend at the roadside along with a temporary permit. Miss the window and the suspension proceeds no matter what the court later decides about the charge.

Why the license moves before the court does

Two processes start on the night of the arrest and run separately. The licensing one is faster, quieter and easier to lose by default.

Separate from any criminal charge, the licensing agency in most states starts its own process to suspend your license. You normally have a short window — in some states as little as seven days — to request a hearing. Miss it and the suspension proceeds regardless of what happens in court. This deadline is the single most common thing people lose by waiting.

The arraignment is where the charge is read and a plea is entered. It is usually short. What matters is what has been prepared before it — whether the stop, the testing procedure and the calibration records have been examined.

Evidence and negotiation

Breath and blood testing depends on equipment being maintained and procedures being followed. Records of both are obtainable. Most cases resolve at this stage rather than at trial.

Beyond any fine or jail exposure, a conviction usually brings an interlock requirement, higher insurance through an SR-22 filing, and a record that follows you. The license side and the criminal side are resolved separately, and finishing one does not finish the other.

How to check if your license is suspended

Go to your own state licensing agency rather than a third-party lookup. Florida checks by license number alone, Texas asks for the number and date of birth, California and New York use an account with authentication. Any site charging you to reveal your status is selling you something the state gives away.

What is a restricted license?
