What is different about Kentucky

Kentucky has no administrative agency stage before conviction. A judge suspends at arraignment, and only in three situations the statute names: refusal of the test, a prior offense or refusal within ten years, or a crash causing death or serious physical injury. Everyone else keeps a license until the case ends. Time spent under pretrial suspension is credited against the suspension that follows a conviction.

This is the part of a DUI case where getting a lawyer late costs the most, because nothing about the deadline is recoverable by arguing well afterwards. It is also why the first question worth asking anyone you call is what they intend to do about the license, not what they think of the charge.
